Estate Planning: Disclaimers

Disclaimers transfer property intended for the disclaimant to another person who would have received the property if the disclaimant had died. Then, for tax purposes, the disclaimant can be treated as never receiving the property. A qualified disclaimer may be valid for federal estate tax purposes, even if it is considered invalid under local law. Disclaimers provide children (who do not want to inherit specific property) a way of transferring the property outside their estates to their children or the decedent's grandchildren.
